The individual, corporation, partnership or other organization that owns or operates this Site is referred to in this document as the “Site Operator,” “we,” “us” or “our.”

By accessing or using this Site, you acknowledge that you have read and understood this document and agree to be bound by it. If you do not agree, you should discontinue using the Site.

Age Restriction and Eligibility

To access or use this Site, you must be at least 19 years of age or have reached the applicable legal age required for cannabis-related content, products or services in the jurisdiction where you reside or access the Site, whichever is higher. You must also satisfy any additional age requirements imposed by applicable law.

By accessing or using the Site, you represent and warrant that you satisfy all applicable age requirements. If you do not meet these requirements, you must not access or use the Site, submit information through the Site, or subscribe to any mailing list. The Site Operator reserves the right to restrict or terminate access if it reasonably believes that these age requirements have not been met.

1. Purpose of the Site

This Site is provided primarily for general informational and communication purposes.

Unless expressly stated otherwise, information published on the Site does not constitute legal, medical, financial, technical or other professional advice. You should not rely on information on the Site as a substitute for advice from a qualified professional who is familiar with your particular circumstances.

The Site Operator may update, correct, remove or change Site content at any time without notice.

2. Acceptable Use

You may use the Site only for lawful purposes and in accordance with this document.

You must not:

  • use the Site in a manner that violates applicable law;
  • attempt to gain unauthorized access to the Site, its server, email accounts or connected systems;
  • interfere with the security, performance or normal operation of the Site;
  • introduce malware, malicious code, automated attacks or other harmful material;

3. Intellectual Property

Unless otherwise indicated, the Site and its content—including text, graphics, photographs, videos, logos, trademarks, page designs, documents, downloadable materials and software—are owned by or licensed to the Site Operator and are protected by applicable intellectual-property laws.

You may view and temporarily download reasonable portions of the Site for your own lawful, non-commercial use.

No content may be reproduced, republished, distributed, modified, sold, licensed, displayed publicly or used to create a competing product or service without prior written permission from the applicable rights holder.

Names, logos, product names, slogans and designs appearing on the Site may be trademarks or trade names of the Site Operator or third parties. Nothing on the Site grants a licence to use them.

4. Information You Submit

When you submit information through a contact form, newsletter form or other Site feature, you confirm that:

  • the information is accurate to the best of your knowledge;
  • you are entitled to provide it;
  • it does not violate another person’s rights;
  • it is not unlawful, threatening, defamatory or malicious; and
  • it does not contain unnecessary sensitive personal information.

Please do not submit highly sensitive information through a general contact form. Examples include passwords, financial-account information, government identification numbers, medical records or other confidential records unless the Site specifically requests the information through an appropriate secure process.

Submitting a general inquiry does not create a professional, contractual, employment, agency or other special relationship with the Site Operator.

5. Privacy Policy

The Site Operator respects the privacy of Site visitors and handles personal information in accordance with applicable Canadian privacy laws.

“Personal information” generally means information about an identifiable individual. It does not normally include anonymous information that cannot reasonably be associated with an identifiable person.

Information submitted through the contact form

Contact-form submissions are ordinarily delivered to an email account used by the Site Operator. A form provider, hosting provider, security service or email provider may temporarily process, transmit or log the submission.

Newsletter information

When you voluntarily subscribe to a newsletter or promotional mailing list, we may collect:

  • your email address;
  • your name, if requested;
  • the date, time and source of the subscription;
  • information showing how consent was obtained;
  • subscription preferences;
  • delivery, opening or link-interaction information, when the newsletter service provides these functions; and
  • unsubscribe and suppression-list records.

Newsletter participation is voluntary.

Technical and usage information

The Site, its hosting provider or its security tools may automatically process limited technical information, such as:

  • Internet Protocol address;
  • browser and device type;
  • operating system;
  • referring page;
  • pages requested;
  • date and time of access;
  • error, security and server logs;
  • approximate location derived from an IP address; and

This information may be necessary to deliver the Site, maintain security, prevent abuse, troubleshoot errors and understand general Site performance.

You may withdraw consent, subject to reasonable notice and any legal or contractual restrictions. Withdrawal will not affect processing that was lawful before consent was withdrawn.

5.4 Cookies and Similar Technologies

The Site may use cookies or similar technologies.

The Site Operator does not sell or rent contact-form or newsletter information to third parties for their independent marketing purposes.

5.7 Retention

Personal information will be retained only for as long as reasonably necessary for the purposes for which it was collected, including applicable legal, security and record-keeping requirements.

Contact-form messages may be retained while an inquiry is active and for a reasonable period afterward for follow-up, business records, dispute resolution or legal compliance.

Newsletter subscription information may be retained while a person remains subscribed. Limited suppression-list information may be retained after an unsubscribe request to ensure that additional promotional messages are not sent and to document compliance.

Security, server and technical logs may be retained for a reasonable period based on operational and security requirements.

Information that is no longer required will be deleted, securely destroyed or anonymized, subject to technical and legal limitations.

5.8 Safeguards

The Site Operator uses reasonable administrative, technical and physical safeguards appropriate to the nature and sensitivity of the information under its control.

Safeguards may include restricted access, password protection, security updates, spam filtering, encrypted transmission, service-provider controls, backups and staff confidentiality requirements.

No website, email system or Internet transmission is completely secure. The Site Operator cannot guarantee that unauthorized access, interception, loss or misuse will never occur.

5.9 Privacy Incidents

Where a privacy or security incident occurs, the Site Operator will investigate the circumstances, take reasonable steps to contain the incident and comply with applicable notification, reporting and record-keeping obligations.

5.10 Access and Correction

Subject to applicable law and permitted exceptions, you may request:

  • confirmation of whether the Site Operator holds personal information about you;
  • access to personal information held about you;
  • correction of inaccurate or incomplete information;
  • information about how your personal information has been used or disclosed;
  • withdrawal of consent; or
  • deletion of information that is no longer required.

The Site Operator may need to verify your identity before responding. Access may be limited where disclosure would reveal another person’s information, confidential commercial information, legally privileged information or information that cannot legally be disclosed.

Where a request cannot be fulfilled, an explanation will be provided when required by law.

5.12 Children’s Information

The Site is intended exclusively for persons who satisfy the age requirements set out in the Age Restriction and Eligibility section and is not directed to children or minors.

A parent or guardian who believes that a child or minor has submitted personal information should contact the Privacy Officer so the matter can be reviewed and appropriate action can be taken.

6. Newsletter and Electronic Communications

A person will be added to a promotional newsletter list only where the Site Operator has a valid basis for sending the communication, including express consent where required.

Newsletter consent should be obtained through a clear and separate opt-in. The newsletter checkbox must not be pre-selected.

Promotional electronic messages will contain the identification and contact information required by applicable law and a readily available unsubscribe mechanism.

A subscriber may withdraw consent at any time by:

  • using the unsubscribe link in an electronic message; or
  • contacting the Site Operator through the contact information provided on the Site.

Unsubscribe requests will be processed within the period required by applicable law. A limited record may be retained to ensure that the unsubscribe request continues to be respected.

Unsubscribing from promotional messages will not necessarily prevent the Site Operator from responding to an inquiry or sending a non-promotional message that is required or permitted by law.

8. Accuracy and Availability

The Site Operator attempts to provide useful and accurate information but does not guarantee that Site content is complete, current, accurate or suitable for a particular purpose.

To the maximum extent permitted by applicable law, the Site Operator and its directors, officers, employees, contractors, representatives, affiliates and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or connected with:

  • inability to access the Site;
  • reliance on Site content;
  • third-party links or services;
  • loss of information;
  • unauthorized access;
  • malware or security incidents; or
  • interruption of business or loss of revenue, opportunity, reputation or data.

Where liability cannot lawfully be excluded, liability will be limited only to the extent permitted by applicable law.

Nothing in this section limits liability for fraud, wilful misconduct, gross negligence or any other liability that cannot legally be limited.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Site Operator and its representatives from claims, liabilities, losses and reasonable costs arising from:

  • your unlawful misuse of the Site;
  • information or material you submit;
  • your violation of this document; or
  • your infringement of another person’s rights.

This section does not apply to the extent that a claim results from the Site Operator’s own unlawful conduct.

12. Accessibility

The Site Operator aims to provide Site content in a reasonably accessible manner and to improve accessibility where practical.

A person who experiences difficulty accessing information on the Site may contact the Site Operator to request assistance or an alternative format. The Site Operator will review accessibility requests in accordance with applicable law.

13. Governing Law

This document and use of the Site are governed by the laws of Canada and the laws of the province or territory in which the Site Operator has its principal place of business, without regard to conflict-of-law principles.

Subject to any mandatory consumer-protection or jurisdictional rights, legal proceedings relating to the Site will be brought before a court of competent jurisdiction in that province or territory.

14. Changes to This Document

The Site Operator may amend this document to reflect:

  • changes to Site features;
  • changes to information-handling practices;
  • new service providers;
  • legal or regulatory developments; or
  • operational requirements.

The revised version will be posted on the Site with an updated revision date.

Where required by law, additional notice or consent will be provided before a material change takes effect.

Continued use of the Site after a change takes effect constitutes acceptance of the revised Terms of Use. Changes to privacy practices will not retroactively authorize a materially different use of previously collected personal information where additional consent is legally required.

15. Severability and Waiver

A failure by the Site Operator to enforce a provision does not waive the right to enforce it later.
